This Class Action Waiver is part of the legal terms governing use of the Liamgo platform (the “Platform”), including the mobile application, website, and related services.

By accessing or using the Platform, you agree to the terms of this Class Action Waiver.

1. Waiver of Class Actions

To the fullest extent permitted by applicable law, you agree that any disputes, claims, or controversies arising out of or relating to your use of the Platform, including any services provided through Liamgo, will be resolved on an individual basis only.

You expressly waive the right to:

  • Participate in a class action lawsuit
    • Act as a class representative
    • Join or consolidate claims with other users or providers
    • Participate in any class-wide, collective, or representative proceeding

2. Individual Dispute Resolution Only

All claims must be brought solely in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

Unless otherwise required by law, no arbitrator, judge, or other decision-maker shall have authority to:

  • Consolidate multiple claims into a single proceeding
    • Preside over any form of class or representative action
    • Award relief on behalf of any group or class of users

3. Relationship to Arbitration Agreement

This Class Action Waiver applies to all disputes and is intended to be read in conjunction with the Liamgo Dispute Resolution and Arbitration Policy.

If arbitration is applicable, it will be conducted on an individual basis only, consistent with this waiver.

4. Severability

If any portion of this Class Action Waiver is found to be unenforceable or invalid under applicable law:

  • That portion shall be severed
    • The remaining provisions shall remain in full force and effect

However, if a court determines that the waiver of class or representative actions is unenforceable, then the dispute may proceed in court, but only to the extent permitted by law.

5. Exceptions (If Required by Law)

Nothing in this waiver shall prevent you from:

  • Bringing an individual claim in small claims court (where applicable)
    • Seeking relief as permitted by applicable consumer protection laws

6. Changes to This Waiver

Liamgo reserves the right to update or modify this Class Action Waiver at any time.

Updates will be posted with a revised “Last Updated” date.

Continued use of the Platform after such updates constitutes acceptance of the revised terms.
